The Federal government in its 2012 budget has made changes to the category of qualified donee called ?Gifts to Certain Charitable Organizations Outside Canada?. There are currently 9 foreign charities that are in a list ?Gifts to Certain Charitable Organizations Outside Canada?.? You can see all 9 of them at:? http://www.cra-arc.gc.ca/chrts-gvng/qlfd-dns/qd-lstngs/gftsfrmhrmjsty-lst-eng.html? The CRA information circular describes these organizations at: http://www.cra-arc.gc.ca/E/pub/tp/ic84-3r6/README.html? FInance is proposing to modify the rules to allow the CRA in consultation with Finance to recognize such organizations only if they are ?? related to disaster relief or urgent humanitarian aid; or ? in the national interest of Canada.?? This is a narrowing of the categoy - however, I think that having clarity will be helpful for CRA and it is possible that this category could have a large number of reputable international groups that are invovled with disaster relief and urgent humanitarian aid added over the next few years.? Furthermore, the category ?in the national interest of Canada? may apply to other groups such as those involved with international development (that is not disaster relief or urgent humanitarian aid) or other groups for example dealing with health care. Time will tell but there is a significant category of foreign prescribed universities and perhaps in a few years there will be a few dozen foreign charities added to the ?Gifts to Certain Charitable Organizations Outside Canada? list.? Keep in mind that Canadians have already a lot of choice when it comes to international programs and over 5200 Canadian charities spent funds outside of Canada.? So there is no shortage of places to donate if you want to make this world a better place.?

So essentially the CRA may designate, in consultation with Finance, a foreign organization for a 24-month period from when the Federal government has made a gift to the foreign organization, if
(i) the foreign organization is a charitable organization that is not resident in Canada,
(ii) CRA is satisfied that the foreign organization is (A) carrying on relief activities in response to a disaster, (B) providing urgent humanitarian aid, or (C) carrying on activities in the national interest of Canada, and
(iii) the foreign organization has applied to the Minister for designation under this subsection.

Organizations will have to apply for this status - presumably CRA will ask for information necessary to satisfy itself that the organization should be provided with such status.? Also this status can only be conferred after both CRA and Finance have given the go-ahead.

On page 435 of the Budget Finance notes:

?Gifts to Foreign Charitable Organizations
In general, donations made by Canadians to foreign charities are not eligible for the Charitable Donations Tax Credit or Deduction. However, a foreign charitable organization that receives a gift from the Government of Canada may register as a qualified donee under the Income Tax Act. As a qualified
donee, a foreign charitable organization may issue an official donation receipt for a gift received from a Canadian donor, entitling the donor to a credit or deduction in computing Canadian income or tax. A Canadian registered charity may also make a gift to a foreign charitable organization that is a
qualified donee.

Budget 2012 proposes to modify the rules for registering certain foreign charitable organizations as qualified donees. Foreign charitable organizations that receive a gift from the Government may apply for qualified donee status if they pursue activities:
? related to disaster relief or urgent humanitarian aid; or
? in the national interest of Canada.

After consultation with the Minister of Finance, the Minister of National Revenue will have the discretionary power to grant qualified donee status to a foreign charitable organization that meets these criteria. Qualified donee status will be made public, and will be granted for a 24-month period that
begins on the date chosen by the Minister of National Revenue, which normally would be no later than the date of the gift from the Government. Granting qualified donee status in these situations will ensure that Canadians receive tax relief for donations made to approved foreign charitable
organizations that carry out activities of significance to, and in the interest of, the Canadian public. The Canada Revenue Agency will develop guidance regarding the administration of this measure.

Foreign charitable organizations that have received qualified donee status under the existing rules will continue to be qualified donees until the expiration of the period of their current status.

This measure will apply to applications made by foreign charitable organizations on or after the later of January 1, 2013 and Royal Assent to the enacting legislation.?

Gifts to Foreign Charitable Organizations (p. 475)

(42) That, for applications made by a foreign organization on or after the later of January 1, 2013 and the date of Royal Assent to the enacting legislation,
(a) subparagraph (a)(v) of the definition ?qualified donee? in subsection 149.1(1) of the Act be replaced with the following:
(v) a foreign organization designated under subsection 149.1(26), and
(b) section 149.1 of the Act be amended by adding the following after subsection 149.1(25):
Designated foreign charitable organizations
(26) For the purposes of the definition ?qualified donee? in subsection (1),
(a) the Minister may designate, in consultation with the Minister of Finance, a foreign organization for a 24-month period that includes the time at which Her Majesty in right of Canada has made a gift to the foreign organization, if
(i) the foreign organization is a charitable organization that is not resident in Canada,
(ii) the Minister is satisfied that the foreign organization is
(A) carrying on relief activities in response to a disaster,
(B) providing urgent humanitarian aid, or
(C) carrying on activities in the national interest of Canada, and
(iii) the foreign organization has applied to the Minister for designation under this subsection; and
(b) a foreign organization designated under paragraph (a) is deemed to have been registered by the Minister at the beginning of the 24-month period.

Charitable organizations outside Canada to which Her Majesty in Right of Canada has made a gift enjoy the same ?qualified donee? status as registered charities, meaning they can issue official donation receipts for gifts that then allow donors to claim tax relief and as qualified donees they can receive funds from registered charities.

2. What are the new requirements for certain charitable organizations outside Canada to which Her Majesty in the Right of Canada has made a gift?
Budget 2011 proposes that these organizations be on a publicly available list maintained by the CRA in order to continue to be recognized as qualified donees. These organizations will also be required to keep books and records supporting any official donation receipts they issue, and provide these to CRA upon request.

3. What are the consequences if such an organization does not comply with these rules?

If a charitable organization outside Canada to which Her Majesty in the Right of Canada has made a gift fails to keep books and records supporting any official donation receipts it issues, and to provide these to CRA upon request, or is involved in the improper issuance of donation receipts, the CRA may suspend its receipting privileges or revoke its qualified donee status.

4. What are the requirements to be considered a qualified donee as a charitable organization outside Canada to which Her Majesty in right of Canada has made a gift?
To be considered a qualified donee as an organization outside Canada to which Her Majesty in right of Canada has made a gift, the federal department that made the payment, or the recipient organization itself, should forward the following information to the Charities Directorate, Canada Revenue Agency:
?a copy of the governing document of the foreign entity;
?a description of the foreign entity?s activities;
?a copy of the letter or certificate issued by the foreign authority granting the foreign entity charitable status;
?copies of correspondence, agreements, or other documents related to the Crown gift; and
?proof that the gift has been made (for example a copy of the cheque).

The Charities Directorate will then consider whether the foreign entity qualifies based on a two-part test. First, the organization must demonstrate that it was the recipient of a gift. Second, the organization must demonstrate that it would meet the requirements for registration as a charitable organization in Canada.

5. Is there a current list of these organizations?
Yes. The CRA Charities Directorate maintains a list of these organizations. It can be found through the Charities-related forms and publications pages.

Once the Charities Directorate has determined whether a gift has been made and whether the foreign organization would meet the registration requirements, it will provide written confirmation of its decision. If the organization meets the two-part test, its name will be added to the CRA?s public list.

6. Are books and records required to be kept in Canada?
No. These organizations may keep their books and records in their own jurisdiction but must make them available in Canada at the request of the CRA.

7. When do these new rules apply?
The rules will apply on or after the later of January 1, 2012, and Royal Assent of the implementing legislation. During the interim period, these organizations will continue to be eligible for qualified donee status based on the current rules.

8. Where will I find more information on the proposed measures?
As further information is developed, it will be available on the Charities and Giving Web pages.

You actually save yourself money and time by purchasing quality parts that won?t break in a few months. Coupled with good quality tools is the principle of using them as they are supposed to be used. Tools can sometimes be substituted saving you even more money. It really depends on what you are doing and how specific the tool must be for the job. Every time you use a ladder, you are taking a certain amount of risk. The best thing you can do to remain safe when using a ladder is to minimize the risk of accidents. Always stop and think before using a ladder, and then take the time to do a little inspection. Sometimes cracks will appear on older ladders, or ladders which aren?t frequently used. Folding ladders are wonderful for storage but extra precautions should be taken when using one of these ladders. Make sure the ladder is opened as much as possible, or as per instructions. The folding metal braces that extend should be completely locked before stepping onto the ladder.

When doing electrical work, always be careful of the voltage and amperage that you are working with. Older buildings and houses may have issues that new ones may not have. As the years pass, remember that some screws may be loose which means be careful of loose wires. Some wires may be hot, so you need to test each wire to see if there is electricity running through them. Be wary of insulation that has been exposed to heat or light fixtures for many years as it may be worn out. If there is no longer any protective barrier between you and exposed wires, get this fixed. So these are the small things you should be aware of with electrical components. While safety may not be the first thing you think about when it comes to making improvements to your home, it really should be. However safety really should be the one of the first things to think about before starting to actually do any work. Keep in mind that it only takes a split second for something to happen.

George Zimmerman Defense: Trayvon Martin Struck First, Tried to Grab Gun, Killer Claims

George Zimmerman, the man who shot and killed Florida teen Trayvon Martin, claims the teen was the aggressor, laying him out with a single punch, smashing his head on the ground repeatedly and trying to grab his gun, he tells police.

The neighborhood watch captain has not spoken publicly, but Zimmerman’s version of the nationally controversial Trayvon Martin case leaked on Monday.

The Orlando Sentinel reports that George Zimmerman told police he lost 17-year-old Martin in the Sanford, Fla., neighborhood he regularly patrolled.

He was walking back to his vehicle, he says, when the youth approached him from behind. The two exchanged words briefly then, Zimmerman said.

It was at that point that he claims Martin then punched him, jumped on top of him and began banging Zimmerman's head on the sidewalk.

Zimmerman said he cried for help; Martin's family thinks it was their son who was crying out. Witness accounts differ and 911 tapes are not clear.

A statement from Sanford police, who have not charged Zimmerman, said the Sentinel story was "consistent" with evidence turned over to prosecutors.

Because Martin was black and Zimmerman has a white father and Hispanic mother, the case has become a racial flashpoint that has civil rights leaders and others leading a series of protests in Sanford and around the country.

To the dismay of millions, Geraldo Rivera claimed Martin made himself a target with his hoodie. President Obama even spoke out about the case.

Meanwhile, Martin's parents are blaming police for leaking information about their son being suspended from school for marijuana. Martin's mother, Sybrina Fulton, and family attorneys said it was part of an effort to demonize her son.

"They killed my son and now they're trying to kill his reputation," Fulton told reporters.

Martin was suspended by Miami-Dade County schools because traces of marijuana were found in a plastic baggie in his book bag, family spokesman Ryan Julison said. Martin was serving the suspension when he was killed.

Martin family attorney Benjamin Crump said the link between the youth and marijuana have no bearing on the probe into his shooting death. State and federal agencies are investigating, with a grand jury set to convene April 10.

Sanford Police insist there was no authorized release of the information but acknowledged there may have been a leak. The City Manager, Norton Bonaparte, Jr., said it would be investigated and the person responsible could be fired.

In September 2011, the Independent Commission on Banking under Sir John Vickers presented its final recommendations on reforms to improve stability and competition in UK banking.? The most prominent proposal was the ?ringfencing? of risky investment activities, so that the mundane retail banking needs of businesses and households would not be threatened by future financial crises like that of 2007-9.? PARIS (AP) ? Authorities investigating France's deadly shooting rampage have released the mother of the Islamist fanatic blamed for the killings but were questioning his older brother to determine whether he served as an accomplice, officials said Saturday.

Police are trying to determine whether 23-year-old Mohamed Merah had any help in carrying out the execution-style murders of seven people that have shocked France and refocused attention on the threat of radical Muslim terrorists. Police say there is evidence to suggest that his brother worked as an assistant.

Merah's brother, Abdelkader, was flown to Paris for further questioning Saturday, along with his girlfriend, but a lawyer for Merah's mother, 55-year-old Zoulhika Aziri, said she had been released without charge. Jean-Yves Gougnaud told reporters in the southern French city of Toulouse that Aziri's world had been "turned upside down."

"She is devastated," he told reporters after her release. "At no time could she have imagined that her son was the one who did it."

Aziri was freed late Friday from a police station in Toulouse, a judicial official said on condition of anonymity because the information wasn't cleared for public release.

Mohamed Merah, who claimed allegiance to al-Qaida, died in a hail of gunfire Thursday after a dramatic 32-hour standoff with police at his apartment in Toulouse. At one point, police brought his mother to the scene, but she refused to urge her son to surrender, officials said.

Merah had filmed himself carrying out attacks in southern France that began March 11 and killed three Jewish schoolchildren, a rabbi and three French paratroopers with close-range shots to the head, prosecutors say. Another Jewish student and a paratrooper were wounded, and five police officers were injured trying to dislodge Merah from the apartment.

The killings stunned France and upended the campaign for presidential elections starting next month. President Nicolas Sarkozy held an emergency meeting with his prime minister and top security and intelligence officials Saturday.

Key questions include how Merah, described by French intelligence boss Ange Mancini as "a little failure from the suburbs," was able to amass an arsenal of weapons ? including an Uzi sub-machinegun ? and rent a car, despite having no clear source of income.

Mancini told French broadcaster BFM-TV that Merah told police during the siege that he bought the weapons for about ?20,000 ($26,000), using money he acquired through break-ins and holdups.

Mancini said he believed that Merah was telling the truth about that, but suggested that forensic police would be examining the guns for clues as to where Merah got them.

"The weapons, too, will talk," Mancini said.

Gun violence is far rarer in France than in the United States, where laws are less restrictive. French civilians are banned from owning automatic weapons or handguns, with few exceptions, and licensing is strictly controlled.

That said, hunting is very popular in France and the country has one the Western world's highest levels of private gun ownership, coming in at No. 12 worldwide, according to the University of Sydney's GunPolicy.org website.

The group rates the level of French weapons smuggling as "moderate" and cites a report carried by Le Figaro newspaper in late 2011, which noted that a Kalashnikov rifle can sell for between ?2,000 and ?3,000 ($2,655-$3,980) on the black market.

Investigators are focusing on most trying to figure out whether Merah, a Frenchman of Algerian descent, acted alone.

Merah had claimed that neither his mother nor his brother knew of his plans, but police union spokesman Christophe Crepin told reporters that detectives have already gathered evidence to suggest that Abdelkader may have helped his brother carry out the shootings.

Asked what police had on the brother, Crepin said there was evidence to suggest that Abdelkader Merah had "furnished means (and) worked as an accomplice."

Crepin refused to comment further, saying it was for a judge to decide what charges, if any, to bring. Under French law if either of the two continue to be held beyond the weekend, preliminary charges will have to be filed.

Abdelkader had already come under police radar, according to officials. He was questioned several years ago about alleged links to a network sending Toulouse-area youths to Iraq, but no action was brought against him at the time.

Back in the southern French city of Toulouse, where Merah held out in an apartment building for more than a day against one of France's most elite police units, residents were beginning to return home to inspect the damage.

Video footage shot by police of the inside of Merah's apartment showed a shattered three-room residence strewn with debris from the fighting and gaping bullet holes in the walls.

Building resident Farida Bohama was quoted by France's Le Figaro newspaper as saying nothing would ever be the same.

"I really want to move," she said.

Identified: U.S. military officials on Friday revealed that Staff Sgt. Robert Bales is the American solider accused of killing 16 Afghan villagers on March 11, The New York Times reports. The military didn't disclose his identity earlier over concerns for his and his family's safety. Authorities are holding Bales at a Fort Leavenworth, Kan., prison.

Groundbreaker: Legal experts are saying the conviction of former Rutgers University student Dharun Ravi in a cyberbullying and harassment case broke new legal ground in New Jersey, The Star-Ledger reports. Ravi on Friday was convicted of invasion of privacy and bias intimidation stemming from his use of a webcam to spy on his roommate Tyler Clementi. The roommate jumped to his death from New York's George Washington Bridge after he realized that Ravi had watched his sexual encounter with another man. Legal experts said prosecuting an individual charged with a hate crime linked to an invasion of privacy charge, rather than a charge stemming from a violent crime like assault, set a new precedent.

Arrested: The U.S. Secret Service on Friday arrested actor George Clooney, Martin Luther King III, members of Congress and other activists outside the Sudan embassy in Washington, The Washington Post reports. They were demonstrating against the Sudanese hunger crisis, claiming that the country's president, Omar al-Bashir, kept humanitarian assistance and food away from thousands of his nation's people. Clooney was released from custody later that day.

Wage and Hour Litigation: The latest Federal Judicial Caseload Statistics show that the amount of wage and hour cases rose more than 15 percent between 2010 and 2011, Corporate Counsel reports. Most of the cases are collective actions.

Dead: John Demjanjuk, a retired U.S. autoworker who was convicted of being a Nazi death camp guard, died on Saturday at 91, The Associated Press reports. He had denied any participation in the in the Nazi Holocaust, saying he had been mistaken for someone else.
